References to “we” or “us” in this privacy policy includes ASC and Radical22 together and/or either one of ASC and Radical22 on their own behalf as applicable.

4. How is your information stored? 

We are particularly mindful to ensure appropriate protection and security of our Information Systems. Specific tools allowing us to detect security breaches have been implemented. The implementation of such tools may incidentally entail access by our security services to personal data. This data will be collected and processed for the exclusive purpose of managing the security breach and, in accordance with applicable data protection regulations.

4.1 GDPR Data Protection Notice for Residents of the United Kingdom or the European Economic Areas

This section of our Privacy Policy applies only to you if you are a visitor to our Sites, apps, shop in our online stores or otherwise interact with us as described in this Privacy Policy and are resident in the UK or European Economic Area (“EEA”). Our lawful bases for processing your Personal Data that we are collecting , we rely on performance of contract, compliance with our legal obligations and our legitimate interests (i.e., in providing good customer service). 

If you fail to provide certain personal data when requested, we may not be able to perform the contract we have entered into with you, or we may be prevented from complying with our legal obligations.

4.2 International Transfers

We have implemented standard contractual clauses to ensure adequate safeguards are in place to protect your information where it is transferred to our third-party providers or vendors in territories outside the European Economic Area and Switzerland. Where we share your information with a third-party service provider outside of the European Economic Area and Switzerland (as detailed in the section entitled “How we share the information collected”), we contractually oblige the third-party service provider to implement adequate safeguards to protect your information.

5. Your rights

You may access your personal information and modify or delete it. You may also request a copy of all information we hold about you in a format compatible and structure that allow you to exercise your rights. 

You may request that we correct, amend, erase any information that is incomplete, out of date or inaccurate. 

You may also refuse, at no cost, to be contacted by us, in which case he/she will no longer receive details on DUA™ products or services.

5.1 US rights

5.2.2 Right to Know

You have the right to request that we disclose information about our collection and use of your Personal Information over the past 12 months, including:

  • Our business purpose for collecting Personal Information;

  • The categories of third parties with whom we share that Personal Information; 

  • The categories of Personal Information that we share with those third parties; and

  • The specific Personal Information we collected about you.

In order to have us provide specific pieces of information, we will require a signed declaration under penalty of perjury that you are the consumer whose Personal Information is the subject of the request.

5.2.3 Right to Limit The Use and Disclosure of Sensitive Personal Information 

We do not use or disclose sensitive personal information other than to provide you our products or services as permitted by California law. Rhode does not sell or share sensitive personal information for the purpose of cross-context behavioral advertising.

We collect sensitive personal information based on one or more of the following legal grounds:

  • You have given explicit consent to the collection for one or more specified purposes;
  • Where the collection of sensitive personal information is manifestly made public by you; and/or
  • Where the collection is necessary for exercise or defense of legal claims.

5.2.4.1 Right to Opt-Out of Sharing

5.2.4.2 Right to Opt-Out of Sale

Making Requests to “Opt Out” of the “Sale” or “Sharing” of “Personal Information”
